Preliminary Scope Ruling on Cabinets Imported from Malaysia and Vietnam
KCMA is pleased to announce that the United States Department of Commerce (“Commerce”) issued a preliminary affirmative scope ruling on March 17, 2023, with respect to Chinese wooden cabinets, vanities, and components thereof (“WCV”) being shipped through Malaysia and Vietnam to avoid antidumping and countervailing duty (“AD/CVD”) orders on WCV from China.
This memorandum summarizes Commerce’s preliminary scope ruling as well as the next steps the agency will take.
I. Introduction to the Four Scenarios
In our requests for scope rulings, we requested that Commerce investigate whether the AD/CVD order covers the following four scenarios:
Scenario 1: finished wooden doors, drawer faces, and frames made in China are combined with wooden cabinet boxes and drawer boxes made in Malaysia or Vietnam.
Scenario 2: semifinished Chinese wooden doors, drawer faces, and frames are further processed in Malaysia or Vietnam before being combined in Malaysia with Malaysian or Vietnamese wooden cabinet boxes and drawer boxes.
Scenario 3: semifinished parts of wooden cabinet and vanity doors, drawer faces, and frames (all rails, stiles, and panels) are manufactured in China and then finished in the United States.
Malaysia or Vietnam, and then combined with Malaysian or Vietnamese-made wooden cabinet boxes and drawer boxes.
Scenario 4: finished Chinese wooden toe kicks are combined in Malaysia or Vietnam with all other components required to construct a complete wooden cabinet that was started and finished in Malaysia or Vietnam.
Additional factual information must be submitted by March 30, 2023, and rebuttal factual information by April 6, 2023. Interested parties are then invited to comment on the preliminary
determination by April 20, 2023, and submit rebuttal comments by April 27, 2023.
